Rowling: It’s Only “Legitimate Creative Activities” When You Don’t Earn Royalties

J.K. Rowling sues publisher RDR Books and “feels betrayed” by Harry Potter Lexicon founder Steven Vander Ark because they intend to publish a print version of the same name. Seems Rowling was “accepting” of sites such as the HP Lexicon and others while they were thousands of dollars’ worth of excellent free marketing for her books but not so much now that they plan to publish a book that people will have to, you know, buy with money.

Rowling said she was especially irked that the site’s owner and the lexicon’s would-be publisher, RDR Books, continued to insist that her acceptance of free, fan-based Web sites justified the efforts.

“I am deeply troubled by the portrayal of my efforts to protect and preserve the copyrights I have been granted in the Harry Potter books,” she wrote in court papers filed Wednesday in a lawsuit she brought against the small Muskegon, Mich., publisher.

She said she intends to publish her own definitive Harry Potter encyclopedia.

“If RDR’s position is accepted, it will undoubtedly have a significant, negative impact on the freedoms enjoyed by genuine fans on the Internet,” she said. “Authors everywhere will be forced to protect their creations much more rigorously, which could mean denying well-meaning fans permission to pursue legitimate creative activities.”

Poppycock. Is there a copyright violation in the intended work, or is there not? If there is, then for sure there is a copyright violation in the web site, which therefore should have been shut down by legal force years ago. Something doesn’t comprise “legitimate creative activities” when free (and free marketing) on the web but amount to copyright violation only when there are royalties involved. That she would begin to object only when royalties were involved is only too human-nature obvious. And she has a somewhat overblown concept of authors’ rights if she expects to be able to trample what even she describes as “legitimate” work in the name of preventing outright copyright violation.

Is there a copyright violation? I don’t know (insert I Am Not a Lawyer boilerplate here). But on the surface it seems that if there is, then that standard would surely apply to sites like TheOneRing.net and the books I helped create based on that site. So what if Rowling plans to publish her own encyclopedia? Reference material can be copyrighted but surely not the right to create reference material. Suddenly half of academia would be out of business. Fiction utilizing the characters is different, but a publisher would have to be crazy to put any of that (mostly) swill into print for cash. And nobody really believes that upon publication of Rowling’s own encyclopedia, anybody would say “Oh, well, I already bought Vander Ark’s website in print form, so I don’t really need the definitive word from the author herself,” do they?

She added: “I find it devastating to contemplate the possibility of such a severe alteration of author-fan relations.”

Which is just a sentimental (or, in the British, treacly) way of saying “Our relations will be lovely so long as you do nothing that irritates me, whether it’s actually illegal or not.” Nice.

Urdahl moves up

Thou shalt not go against our Republican Governor.

Courage has left Minnesota's Republican party. Cronyism is alive and well. Great job Marty Seifert!

I guess that was the lesson doled out to 6 GOP legislators who supported a landmark transportation bill on Monday.
"We expect Republicans to follow other Republicans, and there is obviously a mixed message with what happened yesterday," Seifert said at a news conference Tuesday. "We're not taking anyone's secretary away. I'm not throwing their computers down the Capitol steps. I'm not severing their phone lines."

No, he just removed them from any leadership positions.
• Rep. Rod Hamilton, R-Mountain Lake, replaced by Rep. Dean Urdahl, R-Grove City, in the Agriculture, Rural Economies & Veterans Affairs Committee.

• Rep. Kathy Tingelstad, R-Andover, replaced by Rep. Larry Howes, R-Walker, in the Capital Investment Committee.

• Rep. Jim Abeler, R-Anoka, replaced by Rep. Matt Dean, R-Dellwood, in the Health Care and Human Services Committee.

• Heidgerken, R-Freeport, replaced by Rep. Sondra Erickson, R-Princeton, in the K-12 Finance Committee.

• Erhardt, R-Edina, replaced by Rep. Morrie Lanning, R-Moorhead, in the Property Tax Relief & Local Sales Taxes Committee.

• In addition, Rep. Neil Peterson, R-Bloomington, was removed as an assistant minority whip and replaced by Rep. Pat Garofalo, R-Farmington.

Punish courage, reward cowardice. Good work!

While Rep Urdahl was quick to report "threats", it would appear he was a bit slower to report that he would be "promoted" for toeing the GOP party line, while at the same time, throwing his constituents under the bus.

Anyone ever read Wright County Republican?

Why did Drew Emmer remove the name of a legislator who supposedly "threatened" Rep Urdahl? Yesterday morning, he specifically named a legislator in his smear job. Now, the name is suddenly removed, although Urdahl was still "threatened".

Interesting...

So, having the courage to buck one's party and vote in line with one's constituents gets you removed from leadership positions.

The SC Times has an opinion on this as well today.
Most troubling, though, are the aftershocks emanating from the Republican Party and Pawlenty.

Within hours of the override, it became clear the party expects to punish Heidgerken and the other five House members for breaking ranks with the party and instead voting for what they believed was best for their constituents and all Minnesotans.

Heidgerken said he will lose his post as lead Republican on the House K-12 Finance Committee. News reports indicate other consequences could include others resigning similar posts, losing staff and research services, or not getting party support in re-election bids.

The Pioneer Press quoted Pawlenty as follows on this issue: "If you are going to be a team, you know, then there are going to be some team rules and team expectations, and I'll leave that up to the caucus leaders how they are going to address this further."

We expected a lot of things in the wake of this transportation bill passing — safer bridges, higher taxes and, yes, some Election Day changes. We didn't expect our governor and his political party to take such a low road in response to six votes cast for Team Minnesota, for once, instead of Team GOP.

Well said...I agree.

Quick backstory, my GPA is around a 1.9 (about a 2.4 total as i transferred schools) am currently in danger of being dismissed from my current university, and am in line to fail organic chemistry (again) and parasitology (an upper lever zoology course)

1) If I drop my parasitology course, it would put me at part time, does this look bad on a transcript?

2. Whats the whole process for being a carib med student? I mean is the native language english? Does one have to travel back and forth to the states every summer? How about phone calls to the states? Aside from a few trips to ohio to go to cedar point (im from detroit are of Mi.) iv never even been out of the state, let alone the country

3. My orgo prof said his wife is an MD and she heard from her school (not sure where) that if one gets anything below a B in organic that one can pretty much say goodbye to any US med school, and be in trouble even when it comes to carib schools) Iv already failed this clas once, and after the first test and 3 quizzes am averaging another F

Basically what im asking is, should I just give up on any hope of med school, be it DO or carib or whatnot? My extracurriculars are pretty good (around 1000 hrs volunteer work, and shadowing a doc and hope for at least a year of research), however all that would mean nothing with my GPA being so terrible right now, or even failing out (which im guessing would totally destroy any chance whatsoever)

My sister is seeking acceptance to medical school…MD/DO. She was fortunate to have had 2 interviews, but has not had an acceptance yet.

I know there are several books that give you averages for each medical school but I know that is just an average…some folks higher, some lower.

She is 27 years old with best MCAT scores: Verbal: 9; Physical Sciences: 9; Biological Sciences: 6
She spent almost $5000 dollars in: test prep courses, traveling and on seconary applications (lots of them.) Would like to help her narrow her seconary appliations.

Would like your help with the following:

1. Male/Female:
2. Med School accepted to:
3. Your scores (please be honest):
4. Approximate age of acceptance:

If you would rather be private you can email these stats to: mudpiles@yahoo.com

Just need to focus on where to send secondary applications.

ThanX!!!

Alternative Medicine/Therapies

Alternative medicine/therapy is basically any medical treatment/intervention that's not scientifically identified as effective for a specific condition.
Several people choose to use alternative medicines because of the expense of medicines used for multiple sclerosis can be quite expensive.
Alternative therapies consist of a variety of disciplines such as:
God Diet
Exercise Regularly
Herbal Remedies
Yoga
Acupuncture
Aromatherapy
Relaxation
Massage
Positive Attitude
Marijuana

Marijuana is a highly controversial subject matter for multiple sclerosis because while there are some that says it helps them out with the illness, others say there isn't any concrete evidence that says that. Research is ongoing to come to a reasonable conclusion in regards to this.
Although there are some that use alternative therapies only, it's important for those who use the prescribed medicines to practice the alternative therapies as well.

Different categories of multiple sclerosis

There are four different categories for multiple sclerosis and they are:
Benign - It is the least severe type with complete clearing of symptoms when they happen. Approx. 20% of diagnosed cases fall under this category.
Relapsing/remitting - Has more attacks than one with benign, but has long periods of stability. Approximately 25% of diagnosed cases fall under this category.
Secondary chronic progressive - More attacks, more often. The MS can continue to worsen over years, leaving one with moderate to severe disability. Approx 40% of diagnosed cases fall under this category.
Primary progressive - The most severe form of multiple sclerosis. Attacks can be quite severe and slowly progressive with a slim chance of symptoms and disability clearing up. This is the least common form with only approx. 15% of diagnosed cases falling under this category.
I'm diagnosed with relapsing/remitting ms and hopefully by taking the shots, I won't graduate to the other worse categories.

Tink's B-Day Greenbacks

Liberal in the Land of Conservative has the scoop, a Tinklenberg Campaign email that begged for money so that Elywn could spend the evening of his birthday with his wife.
To reach our quarterly financial goal, El needs to raise $1,000 per half hour of phone time.

We know that Elwyn's most recent FEC is report is not as impressive as it should be for a candidate who:

A. Has been through this before.
B. Has as many connections as he has.
C. Hold's Washington DC fundraisers.

So, since math is fun...

Elwyn raised $61,652 in individual money last quarter. So, if Elwyn and Team Tink used the same formula above to reach this fundraising goal, Elwyn spent about 31 hours on the phone fundraising in the 4th quarter. Now, we know it was probably a lot more than that...

Anyway, Muse is right.

When are Tinklenberg and Olson debating?

How many debates have they had down in the 3rd? I've counted at least 9 debates / forums in CD 3.

Is someone scared to debate in the 6th? I know Olson has challenged Bachmann to a debate so I doubt it's Olson who is scared.

Don't make Blueman get in a chicken costume outside of the Tinklenberg Campaign HQ...

Olson reponds to Bachmann's O'Reilly experience

Olson: Bachmann's Fear-Mongering Fails Minnesota

For Immediate Release
Contact: Christopher Truscott

ANOKA—Bob Olson, a DFL candidate in the 6th Congressional District, released the following statement regarding Rep. Michele Bachmann's Wednesday night appearance on the O'Reilly Factor:

"In the wake of the tragic accident in Cottonwood, Minnesotans had a right to expect smart and compassionate leadership from those in power. That Michele Bachmann chose instead to go on the O'Reilly Factor and play along with O'Reilly's fear mongering is absolutely disgusting.

"It's true that we need comprehensive immigration reform, but it's important to remember, as John McCain reminded us recently, that we're all children of God. This serious debate must be handled in a manner consistent with the human decency that has defined our great state for 150 years.

"Countless number of lives were forever changed after that crash. Instead of scape-goating an entire class of people, it's time Mrs. Bachmann demonstrate leadership worthy of her office and the people of Minnesota."

SC Times does not heart Pawlenty

After being duped by Pawlenty in 2006, the SC Times is fighting back...hard.
In 2006, when Gov. Tim Pawlenty was seeking this board's endorsement for a second term, he was asked specifically what he'd do different if re-elected.

Coming off several very partisan sessions, he earnestly responded that he'd wished he had "kept a few pitches in the glove" when it came to partisan bickering preventing progress. Duly impressed, this board took him at his word and endorsed him.

Based on his reaction to the House overriding his transportation veto Monday, we obviously misunderstood him. He wanted to keep those pitches so he could throw high hard fastballs directly at the heads of anybody who disagreed with him.

Seriously, the immature reactions of Pawlenty and the punishments delivered by the Republican Party to six House members who broke ranks with their peers to support the override are inexcusable.

They even evoked the memory of Jesse Ventura!
It's hard to remember a governor providing a better example of not just politically embarrassing behavior, but flat-out bullying. And remember, this state experienced four years of Jesse Ventura.

And to be honest, they aren't too happy with the Marty Seifert's, Tom Emmer's and Dean Urdahl's either.
Speaking of the Republican Party, its leaders at the Capitol and statewide not only showed the same immaturity as Pawlenty, but they gave fair-minded voters ample reason to doubt their own credibility by demoting those who opposed the governor.

Just look at Central Minnesota House Republican Reps. Bud Heidgerken and Dean Urdahl. Heidgerken voted against the governor and lost his post as senior Republican on the House K-12 Finance Division. Urdahl, also a potential swing vote, backed the governor. He's now lead Republican on the House Agricultural, Rural Economies and Veterans Affairs Committee. (He replaced Rep. Rod Hamilton, R-Mountain Lake, who voted with Heidgerken.)

What else can be deduced from such moves other than the Republican Party wants key leadership spots filled not by the most qualified members, but members who put party loyalty first and all other concerns second?

This scathing opinion in the SC Times is the tip of the iceberg for House Republicans. With major bills still looming on the horizon, the obstructionists in the House will be under greater scrutiny. The Times points out that nearly 70% of legislators have supported similar transportation bills for years. Ignoring that political will, democracy in action, will have negative consequences for the GOP in November.

London for the True Tea Snob [London]

The British reputation as tea connoisseurs is overblown, and most locals are content to fuel up with daily mugs of builders brew drowned with milk and sugar. When Americans come to town, they tend to do the fancy tourist high-tea scenario -- which is more about the finger sandwiches than the tea. Nevertheless, a handful of boutique tea salons have popped up in recent years, determined to teach the British what a real cup of quality tea tastes like. At the following highbrow London venues, the discerning tea snob or the merely discerning can choose from hand-tied Chinese green or organic chamomile flowers come teatime. London's top specialty tea spaces range from the uber-chic to the cozy and casual, but all offer only the very best cuppa the world has to offer.
